SMS Messaging Policy

This policy describes the SMS text messaging program operated and sent by bookres (bookres.ai) for reservations guests make at restaurants, bars, venues, and other businesses ("venues") that use the bookres reservation platform to manage their bookings.
1. Who Sends These Messages
SMS messages are sent by bookres — bookres is the sender of record — and identify the bookres platform along with the venue name (for example, "bookres: … at [Venue Name]"). They are delivered through Telnyx using a 10DLC-registered originator owned and operated by bookres.
Program operator and sender (brand): E3 Artisan, Inc., DBA bookres.ai. bookres is the message sender and program operator of record: it owns and operates the 10DLC-registered number, holds the registered 10DLC brand and campaign with The Campaign Registry (TCR), maintains the opt-in/opt-out records, and handles all carrier-required keyword responses (STOP, HELP, START). Venues schedule reservation notifications through the platform — they choose when messages are sent — but bookres is the sender of record, and the underlying messaging infrastructure, compliance posture, and this policy are managed by bookres.
2. Program Description
The bookres SMS program — "Reservations & Customer Care" — sends reservation-related messages — and conducts a two-way customer-care conversation — with guests who provide a phone number and expressly consent during the reservation booking process on a venue's bookres-powered booking page. bookres is the sender of every message in this program, including the customer-care replies described below.
Message types include:
- Reservation confirmations
- Reservation reminders (typically a few hours before the visit)
- Reservation updates or modifications
- Cancellation confirmations
- Waitlist offers and confirmations
- Event-specific notifications (e.g., open-mic-night confirmations) when the venue uses bookres for ticketed events
- Customer-care replies (two-way). A guest may reply to a message or text a question about their reservation, and bookres responds. These replies are sent by bookres and may be generated automatically by an AI-assisted system operated by bookres and overseen by the venue. The conversation is limited to the guest's reservation and venue information.
All messages are reservation- and venue-related — transactional notifications and customer-care replies to the guest's own questions. bookres does not send marketing, promotional, or advertising SMS through this program, and the AI-assisted customer-care replies are never promotional. The same consent also authorizes automated calls (auto-dialer, artificial, or prerecorded voice) about the reservation; calls, where used, are likewise placed by bookres.
3. Message Frequency
Message frequency varies with your reservation activity and any questions you send us. A typical reservation generates one confirmation message plus one reminder message, with additional messages if the reservation is modified, cancelled, or moved off a waitlist — and customer-care replies when you text us a question. This section describes text-message frequency; automated calls, where used, are separate and infrequent.
4. Cost
bookres does not charge guests to send or receive SMS messages. Message and data rates may apply depending on your wireless carrier and plan. Contact your carrier for details.
5. Opt-In Workflow
Express written consent to receive SMS is collected at the time of reservation on the venue's bookres-powered booking page. No SMS is sent before the guest affirmatively opts in. The opt-in is collected electronically via an unchecked checkbox displayed alongside a full program disclosure; there is no paper, verbal, or other opt-in path for this program.
- The guest visits the venue's booking page and selects a date, time, and party size.
- The guest provides a name, email address, and phone number on the guest-information form.
- Immediately above the SMS consent checkbox, the booking page displays a disclosure block — always visible (never collapsed, hidden, or behind a tooltip) — containing: the sender (bookres) and venue/program name, the type of messages sent (automated texts and calls that service the reservation, including two-way customer-care replies), message frequency, the "Msg & data rates may apply" notice, opt-out instructions ("Reply STOP"), help instructions ("Reply HELP"), a link to this SMS Terms & Privacy Policy, and an explicit statement that consent is not required to make a reservation.
- The guest then affirmatively checks the SMS consent checkbox, which is unchecked by default and reads, verbatim: "I agree that bookres may send me automated texts and calls — by auto-dialer, artificial, or prerecorded voice — to service my reservation at [Venue Name], including to confirm and manage it, at the number I provided. Consent isn't required to book."
- The guest submits the reservation by clicking the "Confirm Reservation" button. Submission is allowed whether or not the SMS consent box is checked — guests who do not opt in receive email notifications only and can still complete the booking.
- On submission, when the SMS consent box is checked, an opt-in confirmation SMS is sent to the provided phone number acknowledging consent and providing opt-out instructions.
The opt-in surface presented to the guest at reservation time is reproduced below. The venue name shown in the disclosure and checkbox is substituted at render time with the actual venue the guest is booking with. Consent is not a condition of making a reservation or purchasing any goods or services. Guests may complete a reservation without checking the SMS consent box; email notifications are still delivered, and the reservation is processed normally. The SMS consent and the (separate) marketing-email consent checkboxes are independent and neither is bundled with any required service term.
Opt-in data handling. Phone numbers and opt-in records collected through this workflow are stored only for the purpose of operating this SMS program (delivery, audit, and opt-out enforcement) and are not shared with any unauthorized third party. 6. Sample Messages
Opt-in confirmation (sent immediately after consent):

7. Opt-Out (STOP)
You may opt out of receiving SMS messages from any venue's bookres-powered SMS program at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message. You will receive a one-time confirmation message acknowledging the opt-out, after which no further SMS will be sent.
To re-subscribe after opting out, reply START to a previous message or make a new reservation and check the SMS consent box again.
8. Help (HELP)
Reply HELP or INFO to any message to receive an auto-reply with reservation-management instructions and the venue's contact information. For platform-level questions (privacy, opt-in records, compliance), contact bookres directly at help@bookres.ai.
9. Supported Carriers
The bookres SMS program is delivered through all major US wireless carriers, including AT&T, T-Mobile, Verizon, and their MVNO subsidiaries. Carrier-handled keywords (STOP, HELP, etc.) take effect immediately at the carrier level.
Carriers are not liable for delayed or undelivered messages. bookres and the venue are likewise not liable for delivery delays caused by the carrier network, the guest's device, or the guest's carrier plan.
10. Privacy
Phone numbers, opt-in status, and SMS interaction history are collected and stored by bookres solely for the purpose of operating this SMS program. Specifically:
- No sale or sharing: phone numbers and SMS opt-in data are never sold, rented, or shared with third parties for marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing.
- Limited disclosure: phone numbers are shared only with (a) the venue you booked with, (b) Telnyx and the underlying wireless carriers for the purpose of delivering messages, and (c) legal authorities when required by law.
- Retention: opt-in records and message logs are retained for the period required by carrier and TCR compliance rules. Opt-out records are retained indefinitely so that any future attempt to re-add the same number requires a fresh opt-in.

11. Terms & Conditions
- Consent: by checking the SMS consent checkbox during reservation booking, you provide express written consent to receive automated texts and calls — including by auto-dialer or an artificial or prerecorded voice — sent by bookres (the message sender of record, on the venue's behalf) to service your reservation, including two-way customer-care replies that may be generated by an AI-assisted system, at the mobile phone number you provided.
- No purchase required: consent to receive text messages is not a condition of making a reservation or purchasing any goods or services.
- Message frequency: varies with your reservation activity and any questions you send us.
- Message and data rates: may apply depending on your carrier and plan.
- Opt-out: reply STOP at any time. After opting out you will receive one confirmation message and no further texts.
- Carrier liability: carriers are not liable for delayed or undelivered messages.
- Changes: bookres may modify this policy from time to time. Material changes will be posted on this page with an updated effective date.
